1. Introduction
These Terms and Conditions of Use (“Terms”) govern access to and use of the Homizy mobile application (“App”) and the related services (collectively, the “Service”), developed and managed by Homizy S.p.A. (“Homizy”, “we”, “our”, or “us”).
By accessing or using the App, the user (“User” or “you”) agrees to be bound by these Terms, which constitute a legally binding agreement between the User and Homizy S.p.A.

Homizy S.p.A. operates in the real estate and co-living sector, providing integrated housing solutions and digital services for managing residential spaces, shared areas, maintenance, and community interactions through the Homizy App.

The Privacy Policy is drafted in accordance with Regulation (EU) 2016/679 (“GDPR”) and applicable Italian legislation.
4. Scope of the Service
The Homizy App allows users to:• Digitally manage their co-living experience
• Book and use shared spaces (e.g. kitchens, gyms, coworking areas)
• Submit maintenance and assistance requests
• Manage payments and services related to the lease
• Access and participate in activities and events organized by Homizy
• Communicate with the Homizy team and the resident community
5. Account Creation
To use the App, users must create a personal account and provide accurate and up-to-date information.
Use of the App is strictly reserved for individuals 18 years of age or older.
The User is responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.
6. Booking and Use of Spaces
Bookings of shared spaces and services through the App are subject to availability and to the house rules of the property.
By confirming a booking, the User agrees to comply with the house rules and is responsible for any damage caused during use.
Homizy reserves the right to refuse, modify, or cancel a booking in the event of non-compliance with these Terms or internal regulations.
7. Events and Initiatives
Users may participate in events or activities promoted through the App.
Participation may require prior registration or payment of a fee, as indicated at the time of booking.
Homizy is not responsible for the conduct of participants during such events.
8. Payments and Fees
Some services may require a subscription or an additional payment.Payments are processed exclusively through secure online channels.
Homizy is not responsible for any payment processing errors caused by third-party platforms.
Any applicable refund policies will be communicated at the time of purchase.
The Homizy App can be downloaded free of charge and does not require any access fee.
9. Acceptable Use Policy
The User agrees not to use the Service to:
• Engage in illegal, fraudulent, or harmful activities
• Infringe the rights of third parties, including privacy and intellectual property rights
• Publish or share offensive, discriminatory, or violent content
• Compromise the security or proper functioning of the App
Any violation may result in suspension or termination of the User’s account.
10. Intellectual Property
All intellectual property rights related to the Homizy App, including software, logos, trademarks, designs, and content, are owned by Homizy S.p.A. or its licensors.The User is granted a limited, non-exclusive, revocable, and non-transferable license to use the App solely for personal purposes related to Homizy services.
11. Liability
Homizy takes all reasonable measures to ensure the availability and reliability of the Service but cannot guarantee that the App will be free from errors, interruptions, or malfunctions.Use of the App is at the User’s sole responsibility.
Homizy shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service, except where liability is mandatory under applicable law (e.g. willful misconduct, gross negligence, or personal injury).
The User is responsible for their device, internet connection, and compliance with applicable laws while using the Service.
12. Suspension or Termination of the Service
Homizy reserves the right to:• Suspend or terminate the User’s account in the event of a breach of these Terms
• Modify, update, or discontinue the Service, in whole or in part, at any time
Any changes to the Terms will be communicated via the App or by email.
Continued use of the Service after notification of changes constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction
These Terms are governed by Italian law.Any dispute arising from the interpretation or application of these Terms shall fall under the exclusive jurisdiction of the Court of Milan (Italy).
